• notes: This case was an appeal by the Jefferson administration of a finding that Heth, as collector of customs at Petersburg, had not had his commission income limited by a Congressional act of May 1800 that set such commissions at 2.5% of the value of the cargo declared; the Marshall court upheld the prior decision that Heth's conduct had been secured by bonds that allowed him a larger percentage as his commission and that the conditions of those bonds were still in force, as a two-party contract, despite the newly-set limitations (see.7 U.S. 399, 1806).
  John Breckinridge (1760-1806) was the fifth Attorney General of the United States (1805-06).
